1. Agreement to Terms
These Terms of Service (“Terms”) are a binding legal agreement between you (“you,” “your,” or “Customer”) and JDG Manufacturing LLC, a California limited liability company doing business as EverLittle 3D (“EverLittle 3D,” “we,” “us,” or “our”), located at 7572 Silverado Ln, La Palma, CA 90623. By accessing our website, placing an order, or using our services, you agree to these Terms. If you do not agree, do not use the Site or place an order.
You must be at least 18 years old to place an order. By placing an order you represent and warrant that you are 18 or older and legally able to enter into a binding contract.
2. Our Products and Services
EverLittle 3D designs and produces custom 3D-printed keepsakes based on ultrasound imagery provided by our partner clinics. Our products include (but are not limited to) the Legacy, Heirloom, and Keepsake product lines. Each item is individually made to order based on the scan you authorize your selected partner clinic to share with us.
Not a medical device. Our products are artistic keepsakes for personal enjoyment only. They are not medical devices, are not intended for diagnostic use, and are not a substitute for professional medical advice, prenatal care, or ultrasound imaging performed for clinical purposes. Nothing about our products should be interpreted as a medical opinion, diagnosis, or recommendation. Continue to follow the guidance of your healthcare provider.
3. The Partner Clinic Model
To place an order, you must select an EverLittle 3D partner clinic from our website and attend that clinic for your elective ultrasound session. After your session, the partner clinic uploads your scan file directly to our secure portal on your behalf.
Clinic services are separate. Our partner clinics are independent businesses. Fees for the ultrasound session itself are paid directly to the clinic and are not part of your EverLittle 3D order total. We are not responsible for the scheduling, conduct, outcome, quality, or pricing of your ultrasound session at any partner clinic. If the clinic is unable to capture a usable scan, fails to upload the file, or ceases operations, see Section 8 (Scan Quality) and Section 10 (Refunds and Cancellations).
Your consent to scan sharing. By selecting a partner clinic and placing an order, you authorize that clinic to share your ultrasound imagery with EverLittle 3D for the sole purpose of producing your order. You also confirm that you are the patient depicted in the scan (or the legal guardian of a minor patient) and have the right to authorize its use. See our Privacy Policy for how we handle and retain scan imagery.
4. Orders and Payment
Placing an order. Placing an order constitutes an offer to purchase. We reserve the right to accept or decline any order in our sole discretion, including orders that appear fraudulent, cannot be fulfilled due to scan quality, or originate from a non-partnered clinic. An order is not accepted until we send an order confirmation and receive your scan file from the partner clinic.
Pricing and fees. All prices are in US dollars and displayed on the Site. Applicable California sales tax and shipping are added at checkout. We may change prices at any time, but changes do not affect orders already accepted.
Payment. We accept the payment methods shown at checkout. Payment is charged at the time of order. By providing a payment method, you represent that you are authorized to use it and authorize us to charge the full order amount, including taxes, fees, and shipping.
Errors. Despite our efforts, pricing, images, or descriptions on the Site may occasionally contain errors. We reserve the right to correct errors and to cancel or refuse orders based on inaccurate information, even after an order is confirmed, with a full refund.
5. Custom-Made Goods and Your Right of Cancellation
Every EverLittle 3D product is custom-manufactured to your order using your specific ultrasound scan. Once production has begun, your order cannot be cancelled and is not returnable or refundable except as required by law or as described in Section 10.
You may cancel an order for a full refund only if you submit a written cancellation request to support@everlittle3d.com before (a) your partner clinic has uploaded your scan file, or (b) we have begun modeling work, whichever occurs first. After either event, the order is considered in production.
6. Turnaround Time
Our typical turnaround is approximately 2 to 3 weeks from the date your scan file is received and approved, though this is an estimate and not a guarantee. Turnaround may be longer during holidays, periods of high order volume, equipment maintenance, print failures, or for especially complex scans. We are not liable for delays caused by events outside our reasonable control, including shipping carrier delays, partner clinic delays, force majeure events, or delays caused by your failure to respond to scan-approval requests.
If you need an order by a specific date (for example, a baby shower), contact us at support@everlittle3d.com before ordering so we can advise whether the timeline is realistic. Unless we provide written confirmation of a specific delivery date, no date is guaranteed.
7. Shipping, Risk of Loss, and Delivery
We ship within the United States using the carriers and methods shown at checkout. Shipping times are estimates and begin after production is complete.
Risk of loss passes to you when the package is delivered to the carrier. You are responsible for providing a correct and complete shipping address; we are not responsible for orders shipped to addresses you provided in error. If a package is lost, stolen, or damaged in transit, contact us promptly and we will assist with the carrier claim, but replacement or refund is subject to carrier resolution and at our reasonable discretion.
8. Scan Quality and Your Order
The quality of your finished keepsake depends on the quality of the ultrasound scan. While our partner clinics are selected for their imaging capabilities, factors outside anyone’s control (fetal position, gestational age, maternal anatomy, amniotic fluid levels) can produce scans that do not yield a strong 3D model.
Scan-approval step. Before we begin printing, we will share a preview or summary of what we are able to produce from your scan. You are responsible for reviewing and approving (or requesting reasonable revisions to) the preview within the time we specify. Once you approve, or if you fail to respond within the specified window, we will proceed to print.
If the scan cannot yield a usable model, we will contact you and offer, at our discretion, one of the following: (a) a return appointment with the same partner clinic at no additional charge from EverLittle 3D (clinic may charge its own rescan fee), (b) a partial refund, or (c) a full refund. This is your sole remedy for scan-quality issues.
9. Your Responsibilities
You agree:
To provide accurate shipping, billing, and contact information.
To select a partner clinic and attend your session as scheduled.
To respond promptly to scan-approval and production messages from us.
To review personalization details (plaque text, name spelling, dates, and other custom elements) carefully at checkout and in any confirmation messages — we are not responsible for errors in personalization that match what you submitted.
Not to resell or commercially reproduce EverLittle 3D products without our written permission.
10. Refunds and Returns
Because every order is custom-made, all sales are final once production has begun, except as follows:
Defective or damaged on arrival. If your order arrives damaged or with a manufacturing defect, contact support@everlittle3d.com within 7 days of delivery with photos showing the issue and your order number. We will, at our option, repair, replace, or refund the item.
Personalization errors. If personalization (plaque text, names, dates) does not match what you submitted, we will correct and reship at no charge. If the submitted information itself was incorrect, see Section 9.
Scan-quality resolutions. See Section 8.
No returns are accepted for products that match the approved preview and your submitted personalization, including cases where you change your mind, no longer want the item, or are dissatisfied for subjective aesthetic reasons.
Refunds are issued to the original payment method and typically post within 5–10 business days of approval.
11. Intellectual Property
Our property. The Site, our trademarks (including “EverLittle 3D”), our product designs, our 3D model templates, our processes, our photography, and all other content we create are owned by JDG Manufacturing LLC or our licensors and are protected by US and international intellectual property laws. You may not copy, reproduce, modify, or create derivative works without our written permission.
Your scan imagery. You retain ownership of your ultrasound imagery. By placing an order and authorizing your partner clinic to share the scan, you grant EverLittle 3D a limited, non-exclusive, royalty-free license to use, modify, and process the scan solely for the purpose of fulfilling your order and for our internal quality and process-improvement purposes. We will not use your scan imagery for marketing, social media, or any public-facing purpose without your separate, express written permission.
Finished product photos. Photographs we take of our finished products for internal records or private communication with you are our property. If we wish to feature your specific order in marketing, we will ask for your permission first.
12. Partner Clinic Channel
Orders placed by partner clinics on behalf of their own patients or customers are subject to a separate partner agreement between EverLittle 3D and the clinic. Consumers who order through our standard retail flow are not parties to any partner agreement.
13. Disclaimers
THE SITE AND OUR PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, EXCEPT AS REQUIRED BY APPLICABLE LAW. TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
Because each keepsake is custom-made from a unique scan, we do not warrant that any product will exactly match a rendering, preview, sample photograph, or another customer’s finished product. Natural variation in prints, materials, finishing, and marble base veining is expected.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL EVERLITTLE 3D, ITS OFFICERS, MEMBERS, EMPLOYEES, CONTRACTORS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST DATA, OR EMOTIONAL DISTRESS, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR OUR PRODUCTS, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATED TO THESE TERMS, THE SITE, OR YOUR ORDER WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US FOR THE ORDER GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above may not apply to you.
15. Indemnification
You agree to indemnify, defend, and hold harmless EverLittle 3D and its officers, members, employees, and affiliates from any claim, liability, damage, loss, or expense (including reasonable attorneys’ fees) arising out of (a) your breach of these Terms, (b) your misuse of the Site or products, (c) your violation of any law, or (d) any claim that your submitted scan imagery or personalization content infringes the rights of a third party.
16. Dispute Resolution; Binding Arbitration; Class Action Waiver
Please read this Section carefully. It affects your legal rights.
Informal resolution first. Before filing any formal dispute, you agree to contact us at support@everlittle3d.com and attempt in good faith to resolve the matter informally for at least 30 days.
Binding arbitration. Except for disputes that qualify for small claims court (see below), any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or your order will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in Orange County, California, or by video conference at the arbitrator’s discretion. Judgment on the arbitration award may be entered in any court of competent jurisdiction.
Small claims carve-out. Either party may bring an individual action in small claims court in Orange County, California (or the small claims court of your county of residence, if applicable) for any dispute within that court’s jurisdictional limits, instead of arbitration.
Class action waiver. YOU AND EVERLITTLE 3D AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING. The arbitrator may not consolidate claims or preside over any class or representative action.
Opt-out. You may opt out of this arbitration agreement by sending a written opt-out notice to support@everlittle3d.com within 30 days of your first order. The notice must include your name, order number, and a clear statement that you are opting out of arbitration. Opting out does not affect any other part of these Terms.
17. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws principles. For any dispute not subject to arbitration or small claims court, you and EverLittle 3D agree to the exclusive jurisdiction and venue of the state and federal courts located in Orange County, California.
18. Changes to These Terms
We may update these Terms from time to time. The “Last updated” date at the top reflects the most recent revision. Material changes will be posted on the Site and, where reasonable, communicated via email. Your continued use of the Site or placement of new orders after changes take effect constitutes acceptance of the updated Terms. Changes do not retroactively apply to orders placed before the change.
19. Termination
We may suspend or terminate your access to the Site, or cancel an order, at our discretion if you violate these Terms, engage in fraudulent activity, or misuse our services. Sections that by their nature should survive termination (including Sections 11, 13, 14, 15, 16, 17, and 20) will survive.
20. Miscellaneous
Entire agreement. These Terms, together with our Privacy Policy and any partner agreement where applicable, are the entire agreement between you and EverLittle 3D regarding your use of the Site and orders.
Severability. If any provision is held unenforceable, the remaining provisions remain in full effect.
No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.
Assignment. You may not assign these Terms. We may assign these Terms in connection with a sale, merger, or reorganization of our business.
